    So this came through to the sister in law today.

    Whilst this is a Neurosurgeons interpretation of section 88, she’s confused now as to if she should be driving again.

    Driving licence still shows as surrendered, but his interpretation was it was revoked and then surrendered?

    Her new Qashqai was delivered last week, she’s insured and been driving it….

    Small world...my wife has been under the care of Neurosurgeons at The Walton Centre for the last 3 years !

    The level of care she has received has been exceptional, the issue of her continuing to drive came up and the Consultant had to look on line for the criteria and then decided she was fit to drive.

    It might be worth asking for a letter from the Consultant stating "in my opinion medically fit to drive" and then persuing with DVLA whether revoked or surrendered ? It could simply be the use of incorrect terminology in her medical notes ghat has led to the confusion

    Hiya,

    I hope it’s all going ok with your wife. The centre is fantastic and all has gone well in the last 12 months.


    I will speak to her later and suggest as you say for further clarification or different wording as such.

    Well I am still waiting to hear from DVLA. It's been over a year since last seizure but the medical department are now on strike due to a dispuite about covid. ...my wife's colitis is getting worse as she has to drive more..really pissing me off!

    Wife had two major procedures at Walton, condition has stabilised but sje needs meds for the rest of her life, with 6 month reviews

    Walton did what other NHS centres said was impossible, and we will be eternally grateful to the staff there

    Hope your sister in law keeps improving and can get back behind the wheel

    If the licence is shown as "revoked" by DVLA i would be very wary of her driving...that will appear on PNC if she is stopped by the Police / involved in a RTC

    So a little update. She has phoned Walton and they sad contact DVLA. She called DVLA and they said to call… the hospital.

    Her doctors then called her as they received a copy of that letter but didn’t offer any advice as they did not want to be held accountable.

    She then called back to Walton, they then conceded and said well we’ve said ok for you to drive and providing all conditions under section 88 are met then she should be ok to drive.

    As her licence shows as Surrendered and we’ve gone through the other conditions and also Aviva are insuring her after she called (so call is recorded) she’s concluded she is going to continue to drive.

    Anyway situations improve for you both.

    Having looked thro Gov. UK if the licence is surrendered you can apply for it to be returned if you meet all the medical criteria...Walton appear to be saying she has met all the criteria. And you can resume driving once your application has been received by DVLA.

    If the licence has been revoked by DVLA no driving until the DVLA avise that you can drive.

    Subtle difference !

    I don't know the circumstances, but there is a lesson to be learned here. If I was instructed not to drive for a period, then I would comply, but would not surrender my licence unless I was forced to. There is so much red tape nowadays, it can create problems.

    @aldo I hope that your sister-in-law gets things resolved soon.

    I said exactly the same thing!

    She is very much impulsive and will just do things without considering other options.

    Same with the lease car, I said buy a reasonable run about if you want to drive until you get your actual licence back, but no she wanted the lease which was a riskier strategy.

    Hey ho, you can lead a horse to water and all that.

    My daughter is just the same - I try to give her good advice based on my many years of experience.
    Sometimes, it is welcomed, and other times, I needn't have bothered. You can only do your best. :whistle: :D

    Sounds like my brother in law. You spend an hour giving him advice - after he had asked for it - and he goes over it, time and time again, so an hour ends up as two and then he ignores what you have said.

    I now avoid giving him advice

    DVLA say as a key worker i'm a priority. They have my paperwork including letter from Doctor saying the seizures were never awake seizures and not epileptic. Under section 88 i can't drive. It was revoked even though I wrote and told them about the seizures. Over a year now but the medical branch now on strike till the 31st. And union looking at more strikes. Can't see the point now social distancing has gone in Wales. I expect they'll go back soon as they won't be able to afford to stay on strike. I have sympathy but having prepared furlough claims for over 300 employees since March last year I feel like i'm being unfarily penalised when my doctor is happy for me to drive.

    A most frustrating situation for you indeed.

    Hopefully they’ll see sense and decide not to continue any strike action come September.

    I’d be pretty lost without driving so can only empathise your situation

    I Did write but after a week my MP's secretary wrote back that did I want him to write to DVLA. That's a waste of time.

    Maybe spell out that you want them to lobby the transport secretary.

    I would just say that everything helps. I once had an issue with not being able to drive after an operation and my consultant gave me incorrect info, so I pressured him to write to a panel member on their medical board - who he just happened to know - got my license back and they changed the rules for people in future.

    I did write to the transport secretary as well. However with the medical branch out on strike what can they do?
